Am I going to Jail?
Answer: Jail always feels like a likely outcome when dealing with the IRS or state Department of Revenue. Generally, people do not go to jail for what are called “civil” tax matters like outstanding taxes (regardless of the balance), unfiled tax returns, and the like. The pressure of an IRS or state Department of Revenue matter can feel like jail is a likely outcome. It isn’t.
How am I going to pay the taxes I owe?
Answer: Tax balances can feel like they will never be paid in a lifetime. This can feel overwhelming. The good news is that there are a host of options to address a tax balance that is too large to pay, including a settlement of the balance for less than the total amount owed (Offer-In-Compromise), a partial payment agreement, appealing the matter that created the taxes, and finally, bankruptcy in some settings will eliminate federal and state taxes.
Will the IRS take my property, house, and car?
Answer: The IRS or state Department of Revenue has the power to take your property, including your house and car. This situation feels very threatening. Keep in mind that this is the very last resort for the government, as they have no desire for your property.
My tax returns have been audited and are not accurate. What am I going to do?
Answer: This situation is a little tricky and very unnerving. State Departments of Revenue generally do not pursue inaccurate returns as a criminal offense. They adjust the return in question in the audit and charge a penalty for what is called an understatement of taxes. The IRS, however, can pursue an inaccurate return as a criminal matter. Generally, simple mistakes on your tax returns do not create a situation where the audit results in a criminal matter. Most returns that are not accurate are simply adjusted to the corrected balances via audit, and a penalty related to the understatement of your taxes is charged.
Will the IRS take my wages and bank account?
Answer: The IRS or state Department of Revenue has the power to take your wages and monies in your bank account. This is very threatening. Unresolved collection issues or unfiled tax returns often end up with what is called a garnishment that can take part of your wages or the monies in your bank account.
I am in collections and the IRS has contacted me. How can I represent myself and get a fair outcome?
Answer: This situation feels very threatening. Generally, self-representation in this setting is a bad idea. (See the question on my website where this issue is addressed at length.) First, you likely don’t know the law. Secondly, the emotions of dealing with the IRS or state Department of Revenue will create lots of unresolved anxiety.
Managing Unfiled Tax Returns
Having unfiled tax returns is a fairly common tax issue. The IRS takes a severe view of unfiled income tax returns and may see this as a pattern of behavior that could be construed as criminal. This is often a fairly easy job to get back returns filed. I prepare the filings as an attorney in these settings, creating additional safeguards for my clients.
So You’ve Been Audited
This is at the top of my list for helping clients. I represent multiple individuals and companies during IRS or state Department of Revenue audits. The key issue is to realize that the “win” often does not come during an audit (although sometimes it does)-more likely the “win” occurs with a timely filed appeal. My accounting background is particularly important in these settings when business books and records are at issue.
Eliminating Tax Debt/Bankruptcy
Taxes may be eliminated without bankruptcy through the expiration of the statute of limitations on collections (the period the IRS or state has to collect outstanding taxes); possibly settlement via an Offer-In-Compromise or similar state tax settlement program; or finally, by challenging the original amount of the liability through an appeal.
Bankruptcy also works with taxes-IRS and state. Most people are surprised to learn that “older” income taxes CAN be discharged in bankruptcy.
Appeal of IRS/State Matter
An appeal often allows a bad early outcome in an audit or collection matter to be placed before a decision-maker that takes a more balanced point of view for my clients. Appeal to the United States Tax Court for IRS issues is often a “win” for my clients. Similar appeal processes for state issues are available and often beneficial for my clients.
Wage Garnishment or Bank Levy
Older taxes left undealt with long enough, may lead to the IRS or state addressing payment for you through a garnishment against your wages, or by levying against your bank account. These enforced collection actions by IRS or the state may be challenged with a properly timed appeal.
Criminal Investigation
If your worst nightmare has come true and you’re being investigated by the IRS’ Criminal Investigation Division, you need to have an experienced and competent Attorney to represent your interests. Because jail time and significant fines can be part of this investigation, you need proper representation.

You Owe a Fair Bit of Debt
(25K to 50K)
You owe an amount that can’t be paid off with a lump sum payment and will need to take a form of installment payments to address the balance.
The payment plan is likely going to cause a “squeeze” on the family finances.
Some level of collection activity has started. To “fix” this you will need to look at all options for reducing the indebtedness or a payment plan that works for the family budget.
You Owe Too Much Debt
(50K+)
You owe an amount that is larger than your family finances can afford.
Current family finances won’t get close to paying the balance off. Collection activity (either actual or anticipated) has started and the pressure is going to wreak havoc on your life.
You may be locked up unable to move on to addressing the issue. You need to get matters resolved quickly before IRS puts a lien against your home, levies your bank account, or places a garnishment against your wages.
To “fix” this you will need to look solely at reducing the indebtedness through an appeal of the issue that created the tax problem or tax reduction programs offered by the IRS or state Department of Revenue.
Oh My Gosh! Level of Debt
(Too large to pay off)
You owe an amount that will never be paid off.
This category of tax debt is often common for small to medium-sized businesses with individuals making significant earnings. Collection action is in full swing and there appears to be no light on the horizon line.
You are worried that everything you have worked for in your life will be sucked up in a settlement. You are spending all your time either worrying or attending to the debt. Business income likely has suffered. You need to get matters resolved immediately before matters go from bad to worse.
To “fix” this you may need the intervention of a court to help stabilize you and your family’s finances. You will need help in backing down collections, settlement options, reduction of the indebtedness (if wrong) through appeal, or tax reduction programs offered by the IRS or state Department of Revenue.
