Answer: Jail always feels like a likely outcome when dealing with the IRS or state Department of Revenue. Generally, people do not go to jail for what are called “civil” tax matters like outstanding taxes (regardless of the balance), unfiled tax returns, and the like. The pressure of an IRS or state Department of Revenue matter can feel like jail is a likely outcome. It isn’t.

Answer: Tax balances can feel like they will never be paid in a lifetime. This can feel overwhelming. The good news is that there are a host of options to address a tax balance that is too large to pay, including a settlement of the balance for less than the total amount owed (Offer-In-Compromise), a partial payment agreement, appealing the matter that created the taxes, and finally, bankruptcy in some settings will eliminate federal and state taxes.

Answer: The IRS or state Department of Revenue has the power to take your property, including your house and car. This situation feels very threatening. Keep in mind that this is the government’s last resort, as they have no desire for your property.

Answer: This situation is tricky and unnerving. State Departments of Revenue generally do not pursue inaccurate returns as a criminal offense. They adjust the return in question in the audit and charge a penalty for what is called an understatement of taxes. The IRS, however, can pursue an inaccurate return criminally. Generally, simple mistakes on your tax returns do not create a situation where the audit results in a criminal matter. Most inaccurate returns are adjusted to the correct balances through an audit, and a penalty related to the understatement of your taxes is charged.

To “fix” this, you will need to look solely at reducing the indebtedness through an appeal of the issue that created the tax problem or tax reduction programs offered by the IRS or state Department of Revenue.

The tax relief industry seems like shark-infested waters. But hey! They’re not sharks – they’re just smart marketers. To me, they had the knowledge, credentials, and strategies to solve my problems, but would they just consult i.e. absorb my situation then provide options & solutions? Nope! But I quickly realized it’d be OK if I hadn’t because, again the exception here, he flowed detailed information freely …and their contract never came up. Wait. What?! The guy was honest, sincerely interested, eminently qualified, brilliant, and, I must say, classy yet humble. Rare breed. Mensch.

My path forward happens to be one that I can navigate myself - one with favorable timing and costs plus it’s likely safe, but, if needed, I know I have a par excellént, best-in-class tax legal beagle ready in my corner: Dale Kennedy. And in time I’ll likely need him/them. If my situation was different, I’d jump in with them right away. Either way, I have confidence in these folks at Kennedy to have my back.

In life, truth is that the more we give spiritually, the more we get spiritually. It seems too few people in our lives embrace and live this truth. This man, Dale Kennedy, gets it and lives it.
